Class MA refers to a Permitted Development Right (PDR) in England and Wales that allows the conversion of commercial buildings (Use Class E) into residential properties (Use Class C3 dwellinghouses) without a full planning application, though a prior approval application is still required to assess specific impacts such as highways, flood risk, and contamination. This right was introduced to provide a mechanism for redeveloping vacant or redundant commercial properties, aiding in the creation of new homes and revitalizing town centres. 

What is Class MA?

  • A Permitted Development Right:

    It's a planning policy that grants the ability to change the use of a building without needing to submit a full planning application, replacing older, more complex procedures. 

  • Commercial to Residential:

    Class MA specifically allows for the conversion of buildings within Use Class E (commercial, business, and service uses) into residential units. 

  • Prior Approval Required:

    Although it's a permitted development, a prior approval application must be made to the local planning authority to assess potential impacts, such as transport, highways safety, contamination, flood risk, and noise. 

  • To Create Homes:

    The primary goal of Class MA is to increase the supply of residential dwellings by enabling the repurposing of commercial spaces like shops, offices, restaurants, cafes, and gyms. 

Key Aspects and Considerations

  • Eligible Properties:

    The right applies to most buildings in Use Class E, but some restrictions exist. 

  • Restrictions and Exclusions:

    Class MA may not apply to certain buildings, such as those in areas of outstanding natural beauty, listed buildings, scheduled monuments, or safety hazard zones. 

  • Article 4 Directions:

    Local planning authorities can remove these permitted development rights by issuing an Article 4 direction, which prevents Class MA conversions in specific areas. 

  • 2024 Changes:

    Updates came into effect in March 2024, modifying the requirements and scope of Class MA conversions. 

  • No External Alterations:

    Generally, no external alterations are allowed, and any assessment of the impact on the local Conservation Area is relevant for ground-floor conversions.
